Terms of Service

1. General Provisions

These Terms of Service govern the use of the Wavox platform (wavox.ai), which provides AI-powered voice communication automation services. The service provider is Wavox (the Provider). Using the services constitutes acceptance of these Terms.

2. Definitions

• Platform – the wavox.ai website together with related APIs and applications
• Client – a legal entity or sole trader using the Platform under a service agreement
• Voice Bot – an automated AI agent handling inbound and outbound phone calls
• Subscription – a recurring plan granting access to specific Platform features
• Account – the Client's individual account within the Platform

3. Scope of Services

• Automated AI-powered inbound and outbound voice calls
• Call transcription and conversation analysis
• Lead qualification and transfer to CRM systems
• Management dashboard for bots, scripts and statistics
• Integrations with external tools (CRM, Google Sheets, email)

The Provider reserves the right to modify the scope of services with 14 days' notice.

4. Registration and Account

• Registration requires accurate company data and acceptance of these Terms
• The Client is responsible for the security of their account credentials
• One account is assigned to one legal entity
• The Provider reserves the right to verify the Client's identity

5. Payments and Subscriptions

• Fees are charged in advance for each billing period (monthly or annual)
• Current pricing is available at wavox.ai
• Non-payment results in account suspension 7 days after the due date
• Refunds are available only as required by applicable law
• The Provider reserves the right to change pricing with 30 days' notice

6. Provider Obligations

• Targeting Platform availability of 99% per calendar month (SLA)
• Notifying Clients of planned maintenance at least 24 hours in advance
• Ensuring data security in accordance with the Privacy Policy
• Providing technical support during business hours (Mon–Fri, 9:00–18:00 CET)

7. Client Obligations

• Use the Platform only for lawful purposes and in accordance with these Terms
• Not share account access with unauthorised third parties
• Comply with telecommunications law when making and receiving calls
• Obtain required consents from call participants for recording and processing
• Promptly notify the Provider of any account security breaches

8. Intellectual Property

All intellectual property rights in the Platform, including source code, algorithms, interfaces and documentation, belong exclusively to the Provider or its licensors. The Client receives a limited, non-exclusive, non-transferable licence to use the Platform solely for its own business purposes.

9. Limitation of Liability

The Provider is not liable for indirect damages, loss of profits or data loss, unless resulting from intentional misconduct or gross negligence. The Provider's total liability is limited to fees paid in the 3 months preceding the event giving rise to the claim. The Provider is not liable for the operation of third-party systems (telecoms networks, CRMs, third-party APIs).

10. Termination

• The Client may terminate at any time via the account dashboard – effective at the end of the current billing period
• The Provider may terminate with immediate effect in case of material breach
• The Provider may terminate with 30 days' notice without cause
• After termination, the Client's data is retained for 30 days and then deleted

11. Governing Law and Dispute Resolution

These Terms are governed by Polish law. Disputes shall first be resolved amicably, and failing that, before the court with jurisdiction over the Provider's registered office. Legal basis: Polish Civil Code, Act of 18 July 2002 on the Provision of Electronic Services.

12. Final Provisions

These Terms take effect on the date of publication. Amendments are announced on the Platform with 14 days' notice. Continued use after that period constitutes acceptance. Matters not regulated herein are governed by Polish law.
